You agree at all times to defend, indemnify, and hold harmless Dr. Trish Leigh is Leigh Holdings., our shareholders, directors, officers, employees, affiliates, successors, transferees, assignees, distributors, licensors or licensees, and their respective parent and subsidiary companies, agents, associates, offices, directors, shareholders and employees of each from and against all claims, causes of action, damages, liabilities, costs and expenses, including legal fees and expenses, arising out of or related to your use of or inability to use any Dr. Trish Leigh Programs, your violations of these Terms, your violation of any third-party rights through use of the Dr. Trish Leigh Programs, your User Content, or your violation of any private Facebook group pages, social medial site rules or community guidelines, applicable laws or regulations. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any matter without our prior written consent. We are not a medical provider. Do not send protected health information “PHI” to us.

SECURITY AND CONFIDENTIALITY

If you are paying for a Dr. Trish Leigh Program by PayPal or credit card, you give us permission and authorization to automatically charge your credit or debit card as payment for the Dr. Trish Leigh Program. You will receive an electronic receipt. For any installment payment, you give us permission to automatically charge your credit or debit card at the time it is due without any additional authorization.

In the event that payment is not received by the date due, whether paying in full or by installment, you will have a three (3) day grace period to make the payment, otherwise your access to the Dr. Trish Leigh Program may not continue.

If you fail to make payment in a timely manner in accordance with these Terms or voluntarily decide to withdraw from any Dr. Trish Leigh Program at any time or for any reason whatsoever, you still will remain fully responsible for the full cost of the Dr. Trish Leigh Program.

When you purchase a Dr. Trish Leigh Program, the information provided and obtained as part of the transaction, such as your credit card number and contact information, may be collected by both the third-party merchant or payment provider and by us. The merchant may have privacy and data collection practices that are different from ours. We have no responsibility or liability for the payment provider’s independent policies.

You agree to purchase and use any Dr. Trish Leigh Programs for your own legitimate, personal, non-commercial purposes only. You also agree not to make any purchases for speculative, false or fraudulent purposes or for the purpose of anticipating demand for a particular product or service.

REFUND POLICY

Your satisfaction with the Dr. Trish Leigh Programs is essential to us. However, because of the extensive time, effort, preparation, and care that goes into creating and providing the Dr. Trish Leigh Programs, you acknowledge that we do not offer refunds for any portion of your payment for any Dr. Trish Leigh Programs. By using and purchasing any of the Dr. Trish Leigh Programs, you understand and agree that sales are final, and no refunds will be provided for any reason. In the rare event that we choose to issue a full or partial refund to anyone for any reason, a surrender fee of 5% will be deducted from the initial or non-refundable payment, and a refund for the balance will be credited/refunded to your account. Should we choose to issue a full or partial refund, it must be within seven days of purchase or no more than 15% of program completion, whichever comes first. If the program is on a monthly subscription drafted on the same day as the original purchase date, we must receive the cancellation request within seven days of the subsequent withdrawal. Cancellation for a subscription will be for the following month. This request can be completed online using your Ruzuku Learning Library Platform or email. It is solely within our discretion, and our exercise of this discretion in one particular situation in no way represents that a full or partial refund will be available in a subsequent same or similar situation and is in no way dependent on your results or outcomes.

DISPUTE RESOLUTION

It is hoped that should we ever have any differences, we could be able to work them out amiably through email correspondence. However, should a dispute ever arise between us, we agree now that we will submit to binding arbitration before a single arbitrator, selected jointly, in accordance with the American Arbitration Association Rules. The parties hereby waive their constitutional and statutory rights to go to court and have a trial in front of a judge or jury. Any judgment on an arbitrator’s award, if made, is binding and may be entered into any court having the appropriate jurisdiction. Prior to seeking arbitration, you must submit your complaint to us via email at admin@pornbrainreboot.com. You understand and agree now that the only remedy that can be awarded to you through arbitration is full refund of any payment made by you to date. No award of consequential or of any other damages may be granted to you.

You agree that any arbitration arising out of or related to the Dr. Trish Leigh Programs or these Terms must commence within one (1) year of the date of the claim as submitted by you via email or shall otherwise be forfeited forever. You also agree that should arbitration take place the prevailing party shall be entitled to all reasonable attorney’s fees and costs.

In the event of a dispute between us, you agree to not engage in any conduct or communications, public or private, designed to disparage Dr. Trish Leigh, Dr. Trish Leigh is Leigh Holdings, or any of the Dr. Trish Leigh Programs. Where requested by law or arbitration, of course, you are not prohibited from sharing your thoughts and opinions as part of the legal process.

Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, this shall not affect the validity or enforceability remainder of the Terms which shall be given full force and effect to the maximum extent permitted by law.
